1099 vs W-2 in California (2026)

exact brackets

A salary offer in California is worth more than the salary: the employer pays 6.2% Social Security (up to $184,500) and 1.45% Medicare, plus health premiums and any 401(k) match. A 1099 contractor pays both FICA halves as self-employment tax and buys benefits outright. California income tax then applies according to the model below — not a cloned 5% guess.

Federal gap (same math, every state)

Worked offer: $95,000 salary, $9,000 employer health, 4% match, 30 billable hours per week, 46 billable weeks — the same example as the national 1099 vs W-2 calculator.

PTO is already inside the salary. Counting it again as extra dollars is the usual error; unpaid time off is captured by billing 46 weeks instead of 52.

Pricing a California 1099 against a W-2

Federal payroll tax is the same story in every state: a W-2 employer pays half of Social Security and Medicare; a 1099 contractor pays both halves as self-employment tax on 92.35% of net profit. California then taxes the leftover on both sides through the same FTB brackets. The 1099 side usually shows a larger California bill because there is no employer FICA subsidy and because profit is not reduced by employee pre-tax 401(k) in the same way — unless you fund a Solo 401(k).

California does not sit on the nine-jurisdiction list with a sub-federal 1099-K threshold. Platforms follow the federal 2026 rule: more than $20,000 and more than 200 transactions. A missing 1099-K still leaves the income taxable to both the IRS and the FTB. The 1099-NEC payer threshold is $2,000 federally for 2026 — paperwork, not taxability.

Entity choice changes cash, not the SE-tax formula. A California LLC generally owes the $800 FTB LLC tax once it is doing business here; that is an extra cost on the 1099 side that a W-2 salary never carries. It does not replace estimated taxes on the profit you take home.

Federal 1099-K only: more than $20,000 and more than 200 transactions. This state is not one of the nine lower-threshold jurisdictions. Check it with the 1099-K threshold checker (state pre-selected when California has a special rule).

State % to type into the vs calculator

The vs tool applies one flat % to W-2 wages and to 1099 gross so the compare stays symmetric. For California we suggest 5.55% as a planning figure at a ~$95,000 income — derived from STATE_RATES_2026 (exact brackets), except Ohio W-2 which uses the hub’s ~2.75% individual rate rather than the BID. Open 1099 vs W-2 with California filled in.

QBI (20% of qualified business income, with 2026 thresholds) only exists on the 1099 side and is not in the simple vs rate. Use the all-in-one estimator when QBI or locals decide the offer.

Classification is not a calculator output

Whether a role may be 1099 is a legal test (federal common-law plus any state overlay). PiggyMath prices the tax difference if you are paid as a contractor. It does not decide worker status, issue Form SS-8, or e-file.

Expenses, QBI, and the California line

The break-even rate above assumes the contractor bills $115,068 with $0 expenses and no QBI. Real 1099 work deducts software, home office, mileage, and health insurance (the self-employed health insurance deduction). Those cut SE tax and federal income tax; California may or may not conform. PiggyMath’s state model does not apply a full California return — it applies STATE_RATES_2026 (exact brackets) to a profit proxy.

QBI can drop federal income tax by up to 20% of qualified profit below the 2026 thresholds. It does not reduce SE tax. It does not automatically reduce California tax. Price QBI in the QBI calculator and the estimator set to CA, not as a haircut to the vs tool’s hourly rate.

1099-NEC $2,000 vs what California still taxes

For 2026 a client generally issues Form 1099-NEC only above $2,000. A California client who pays you $1,500 may send nothing. You still have federal SE tax on the profit ($212 at $1,500 with no expenses) and, unless California has no personal income tax, a state line on that same profit. The 1099-K rule for this state: Federal 1099-K only: more than $20,000 and more than 200 transactions. This state is not one of the nine lower-threshold jurisdictions.

Keep invoices even when no form arrives. California Franchise Tax Board (FTB) can still ask how you computed the number on the return. PiggyMath does not e-file and does not store your inputs.

Frequently asked questions

Is 1099 or W-2 better in California?
Neither is universally better. W-2 brings employer FICA and benefits; 1099 brings SE tax, QBI, and deductible expenses. Run the calculator, then weigh risk and control.
Does California change the 1.3×–1.8× rule of thumb?
The multiplier is mostly benefits and unpaid time. California’s income tax applies to both sides; it rarely flips the qualitative answer unless locals hit one side only (Ohio BID vs W-2, Philadelphia net profits).
Will I get a 1099-K in this state?
Federal 1099-K only: more than $20,000 and more than 200 transactions. This state is not one of the nine lower-threshold jurisdictions.
Does a missing 1099 mean the income is tax-free?
No. Payer thresholds ($2,000 1099-NEC federally in 2026; 1099-K as above) govern forms, not taxability.
