Federal gap (same math, every state)

PTO is already inside the salary. Counting it again as extra dollars is the usual error; unpaid time off is captured by billing 46 weeks instead of 52.

1099 vs W-2 with NY State (and maybe NYC)

Both a W-2 salary and 1099 profit hit New York State brackets. The 1099 side also pays the employer half of FICA as SE tax. If you live in NYC, city tax applies to both — but the 1099 side has no automatic city withholding, so under-withholding is the usual failure mode when someone leaves a staff job for contracting without starting estimates.

New York is not on the nine-jurisdiction 1099-K list. Federal $20,000 / 200 transactions applies. Report the income on the federal return and the NY return either way. The $2,000 1099-NEC threshold is federal paperwork.

Classification is not a calculator output

Expenses, QBI, and the New York line

The break-even rate above assumes the contractor bills $115,068 with $0 expenses and no QBI. Real 1099 work deducts software, home office, mileage, and health insurance (the self-employed health insurance deduction). Those cut SE tax and federal income tax; New York may or may not conform. For 2026 a client generally issues Form 1099-NEC only above $2,000. A New York client who pays you $1,500 may send nothing. You still have federal SE tax on the profit ($212 at $1,500 with no expenses) and, unless New York has no personal income tax, a state line on that same profit.
