Self-Employment Tax in New York (2026)

exact brackets

New York uses graduated income tax brackets, with a top marginal rate of 10.9%. That top rate is the number that gets quoted, but it is not what a typical freelancer pays: it applies only to income above the highest bracket threshold, so your effective rate is lower. The federal self-employment tax of 15.3% is separate, applies regardless of state, and is the larger number for most people at moderate profits.

The federal part is the same everywhere

Self-employment tax replaces the payroll taxes an employer would otherwise split with you. As a freelancer you pay both halves: 12.4% for Social Security, on earnings up to the $184,500 wage base, and 2.9% for Medicare with no cap. Together that is 15.3%, charged on 92.35% of your net profit rather than all of it. See SE tax vs employee FICA for why “15.3% of profit” overstates the bill, and 2026 tax constants for sourced wage-base figures.

At $100,000 of net profit federal SE tax is $14,129.55 in New York — exactly as it would be in any other state.

What New York adds: statutory brackets (top 10.9%)

exact brackets State model quality matches the freelancer tax estimator — statutory math on a profit proxy, not a filed state return.

New York taxes ordinary income in bands. The headline 10.9% applies only above the top threshold. PiggyMath marks NY as exact brackets in the estimator: we apply the published single-filer schedule to a profit proxy (Schedule C profit minus the deductible half of SE tax). That is still not a full New York return — no state standard deduction, exemptions, or credits.

NYC local tax and entity fees

New York City residents owe a separate city income tax on top of New York State — often several percentage points effective. PiggyMath’s state brackets are state only; add a local % in the freelancer tax estimator if you live in the five boroughs.

NY LLCs/LLPs may owe publication costs and biennial statements; those are entity compliance costs, not a substitute for personal estimated taxes on freelance profit.

Worked example: $92,000 profit in New York

Single filer, $92,000 Schedule C net profit, no other earned income, no state credits:

Multiplying the whole profit by the 10.9% top rate would suggest ~$10,028 of state tax and overstate this example by about $5,552. That is the trap most “top rate” articles create.

Quarterly payments

State-specific dates and envelopes: quarterly estimated taxes in New York.

If you expect to owe $1,000 or more in federal tax for the year, the IRS expects estimated payments four times a year. Missing them triggers an underpayment penalty even if you settle in full at filing. The safe harbor rule (90% of this year or 100%/110% of last year) and Form 2210 annualized method cover uneven freelance income.

New York estimated income-tax rules are separate — confirm thresholds and vouchers with the state revenue department. Federal safe harbor does not automatically clear a state underpayment.

Frequently asked questions

What is the self-employment tax rate in New York?

15.3%, and it is federal — the same in New York as in every other state. New York's own income tax is separate and graduated, topping out at 10.9%.

Will I pay the 10.9% top rate?

Almost certainly not on all of your income, and most freelancers never reach it at all. Graduated brackets mean each slice of income is taxed at its own rate, so your effective rate is lower than the top marginal rate — often much lower.

Do I make quarterly payments to New York as well as the IRS?

Usually yes. Most states with an income tax expect estimated payments from the self-employed. Check New York's revenue department for the thresholds, which differ from the federal $1,000 rule.
